Can I make Hyundai honour the 5 year warranty?

I recently bought a 2 year old HYUNDAI with 5,600 miles on the clock. The reason for the very low mileage is that the old lady that owned it died. The car then stood in a dealers for well over a year. It still had the plastic film on the mirrors and stereo and is in immaculate condition. Unfortunately when I contacted Hyundai they said that it should have received a 1 year or 10,000 miles service and so the warranty is void. This seems ridiculous as the car is virtually new, in spite of it being 2 years old. The dealer should have got it serviced but didn't. Do I have any legal standing with Hyundai?

We've got 2 issues here...



1. Warranty should be transferable to the new owner. Always warranty on new vehicle goes with the car and not with the owner. The extended warranty does not go with the car and goes with the owner (non transferable most of the times). In this case, the dealer appears to be stiff and I would recommend you to talk to dealer Principal or General Manager.



2. You are using your new Hyundai as a Taxi. All manufacturers have certain regulations with regards of use of the vehicle and TAXI use is a special circumstance that gives you a limited warranty coverage. For this matter, I would recommend you to contact the Hyundai manufacturer in your Country and clarify the warranty coverage, giving your circumstances. The manufacturer is in best position to tell you all the aspects related to warranty. Dealer will have to follow protocols with regards of manufacturer's policy and procedure.

The warranty is the best in the business. There are things that are required to maintain warranty. It is not unreasonable that the manufacturer would want to see that the normal maintenance was performed. Have you spoken with the district manager personally? If the dealership has not found evidence of neglect this should be a very simple claim. I work at a Hyundai dealership and in ten years have not seen a claim denied if the inspection doesn't show neglect.

People are reading this the wrong way, Hyundai has NOT said that the warranty is not transferable, but that it is void as the warrant conditions were not met. The warranty conditions clearly state that the vehicle must be serviced at 1 year or 10k miles. It was not serviced at one year and nor has it been serviced, so silly as it seems, legally the warranty is void and Hyundai are 100% within their rights to say so. You have no come back at all with Hyundai i am afraid.



I would share your opinion on Hyundai cars, they have come on in leaps and bounds in recent years and now make a good buy.

You cannot - one of the conditions is a time or miles service which it did not have so the warranty does no longer exist.

It would have been transferable if the servicing had been done.



Hyundai are doing nothing wrong. If the dealer said it was still under manufacturers warranty, when obviously it is not your argument is with them and not Hyundai.

recently bought a 2 year old HYUNDAI and most warranty is void when its sold to another person other than one who had it first and really warranty worth about as much as the paper its on and that goes for most cars

2 yrs old shouldnt need it or worry about it my car is over 20 yrs old still running

HYUNDAI cheap low class car shouldnt have payed for it first off but thats another story

no legal standing with Hyundai but you can buy a warranty and or insurance i drive fords cause i know they dont break down as much Hyundai low on list of great cars

check the warranty info, many warranties do transfer over to other owners but sometimes you do need to bring it in for it to be looked at. what is wrong with the car?

No - second hand cars do not tranfer their warranty.
